Can someone from Fibaro please tell me why the website has not been updated and a statement made in relation to the finding against Fibaro of false advertising that I successfully pursued. The finding was issued in December and 3 1/2 months later, the same false advertising in relation to wireless updating is still present on the site.

I understand that you are stating wireless firmware update of the modules? If this is the case then its not false. Fibaro modules support that (most of them). Other issue is that Fibaro HC2/Hclite do not offer such functionality...yet. I know that this is something on the roadmap but cant say when it will be available for all hc owners.

on the roadmap - what roadmap? Are you kidding?

 

The only thing coming out is buggy firmware called stable 4.080 - Roadmap would indicate Fibaro knows something, and they don't since buggs that has been reported waaaay back is still in the firmware.

A reference or some more information would be helpful.

 

Bamsefar. Fibaro has a plan eg a roadmap. It is not know to the public, hence we are in the dark as to say wether it is a sound plan or not...

    Sorry yes I should have been clearer, i took a case initially with the Irish Advertising Standards who passed it to there Polish counterparts given that Fibaro are based out of Poland. A panel found that Fibaro were falsely advertising that modules were capable of wireless update given that the controller does not support it and that this constitutes false advertising. I have the ruling document in polish that I will upload shortly. 

     

    They have been advertising this functionality for over 2 years that I'm aware of and was one of the main reasons for me spending over 3000 euro on solely Fibaro products before I found out what they were really like.

    Thank you for a solid response! My polish is not up to snuff. You should not happen to have en English translation? A follow up question if I may. This ruling, what is the actual authority / practical out come?

    Yes I know, I could do it by google. Legal stuff - I prefer a notch up. So to get it as close to possible from the horses mouth I ask. I think a translation in English posted here could be enlightening for more than just me... Btw I also added a question. Translation is one thing, understanding is at a higher level.

    ), it was transferred to them from the Irish Advertising Standards agency so i assume they are the Polish equivalent. I had sent a query back to the lady I had been communicating with a number of weeks ago as to what should happen next as also asking why Fibaro had not changed the website to remove the content that had been deemed as false advertising. The response below

     

    "Self-regulation by its nature is voluntary, so the resolutions of the Committee of Advertising Ethics  are not administrative decisions, their implementation is also not mandatory for companies which are not members of one of the organizations that make up the Council.

     

    ​I was extremely annoyed by this and am looking to take it further through The Online Dispute Resolution of the European Commission

    Thank you clarifying - and disappointing.  This type of setup of a voluntarily council has been tried a number of times with limited success. I am at loss how ever as to why Fibaro as a company that probably are fairly dependent on their reputation should for one put them self in a situation like this, two not rectify the issue when a third party like mentioned has made their judgement, and three I they feel different choose not to explain themselves to their customer base.

     

    Fibaro it is paramount that you keep trust - I continue to press this issue as smart home systems are becoming more and more mainstream business!

    Guess its the same old story from Fibaro, ignore anything you don't want to respond to, including support requests and users. Anything that in any way reflects negatively on the company or product is just ignored, we will see where that gets you.
