It is a step forward and we should embrace/applaud the effort.  I’ve posted two simple VD.

 

IP rights embedded in the T&C are quite normal really and not too bad but be aware of the rights are you giving  Fibaro to your code in VD and scene.  I imagine it is the same rights on the forum postings of VD and scenes in any case.


By sharing an Application using Marketplace, Autor gives the Services Provider a  nonexclusive, worldwide, royality-free, lifetime license, with a right to sublicense, allowing Services Provide to distribute, reproduce, execute and usa of Application under commercial purposes including maintenance, promoting and improvement of Marketplace, additional Services and to promote devices and services that allow the usa of Application.

 

You will note that the intellectual property rights you give to Fibaro are quite generous albeit non-exclusive.  It lets them sublicence (i.e. sell) your VD or scene,  use it to market Fibaro products and services,  use it to "maintain" Marketplace and additional services.   As it is non-exclusive, you too can do all these things with the code of your VD or scene as well.  In all cases you are accountable if you have deliberately or accidently infringed on someone else's IP rights.
